Questions moms ask ✦
Short, plain answers, each with a link to the official source.
Friendly reminder: this isn't legal advice. It's an estimate based on California and federal rules (current as of October 16, 2026) to help you prepare for your conversation with HR and EDD. Your employer's policies, your union contract, and EDD's final decision may differ. When in doubt, confirm with HR, EDD, or free help from Legal Aid at Work (800-880-8047).
Pay
Is the first week of disability pay unpaid?✦
Yes, the first 7 days of a DI claim aren't paid. PFL has no waiting period.
Sources: edd.ca.gov ↗ · edd.ca.gov ↗
How much will I get paid?✦
About 70–90% of wages from your highest-earning quarter 5–18 months back, $50–$1,765/week in 2026. Use EDD's calculator for a better estimate.
Sources: edd.ca.gov ↗ · edd.ca.gov ↗
Is it taxed?✦
PFL is taxable on your federal return, not California's. DI usually isn't taxable.
Source: edd.ca.gov ↗
Can my employer make me use vacation first?✦
Not before PFL, since Jan 1, 2025.
Source: edd.ca.gov ↗
When do I file?✦
DI: no earlier than day 9 and no later than day 49 of your disability. PFL: within 41 days of the bonding leave start, not before. Birth moms get the PFL form (DE 2501FP) automatically after the final DI payment.

Job protection
Does SDI or PFL protect my job?✦
No, they only pay. PDL, CFRA and FMLA protect your job.
Source: edd.ca.gov ↗
How long is PDL?✦
Up to 4 months per pregnancy (17⅓ weeks; 693 hours if you work 40 hrs/week, pro-rated for part-time), only while you're disabled.
Source: law.cornell.edu ↗
Does my health insurance continue?✦
Yes, during PDL, CFRA and FMLA, if your employer normally pays for it.
Source: calcivilrights.ca.gov ↗
Can I split up bonding leave?✦
CFRA: blocks of at least 2 weeks, plus two shorter times, within a year of birth.
Source: calcivilrights.ca.gov ↗
Special situations
Can I take leave before 36 weeks if I need bed rest?✦
You may be able to start DI earlier than the usual 4 weeks before your due date if a pregnancy-related condition keeps you from doing your regular work and your licensed health professional certifies it. Pregnancy or bed rest alone doesn't guarantee payment; EDD also checks wage loss and eligibility. PDL may protect medically needed time off at an employer with 5+ employees, within its per-pregnancy limit. Ask your provider, HR and EDD to confirm your dates. This planner keeps the usual recovery estimate; it doesn't calculate an earlier medical leave.
Sources: edd.ca.gov ↗ · calcivilrights.ca.gov ↗
Can I ask for lighter duties, lifting restrictions or more breaks?✦
Yes. California employers with 5+ employees must reasonably accommodate pregnancy-related medical needs, such as temporarily changing duties, providing a stool or chair, or allowing more frequent breaks. If medically needed, a transfer to less strenuous or hazardous work is required when that work is available. Talk with your provider about what you need and ask HR about accommodations. These are workplace protections, not a promise of DI pay. Free help: Legal Aid at Work, 800-880-8047.

I'm expecting twins or multiples. Does my leave change?✦
Don't assume your leave or pay doubles for twins or multiples. DI depends on how long your provider certifies that you can't do your regular work, and on EDD eligibility. PFL provides up to 8 weeks of benefits in a 12-month period, not a separate allowance for each baby. Ask your provider about your recovery needs and confirm your dates with HR and EDD. This planner keeps the usual 6- or 8-week recovery estimate; your medical needs may be different.

Can undocumented workers get leave or DI and PFL pay?✦
EDD says undocumented California workers can apply for DI and PFL, including without a Social Security number. You still need to meet the program's eligibility requirements; approval isn't automatic. DI and PFL pay part of your wages, but don't protect your job. California workplace protections generally apply regardless of immigration status. Employers generally can't ask about immigration status except when required by federal immigration law. You don't need to share your status here. For help with your situation, contact Legal Aid at Work, 800-880-8047, and ask EDD about benefit eligibility.

I started my job less than a year ago.✦
PDL still protects your job (no time-on-job rule, employer with 5+ employees). CFRA/FMLA bonding leave usually needs 12 months and 1,250 hours. SDI/PFL pay can still use wages from a previous California job.
Sources: calcivilrights.ca.gov ↗ · edd.ca.gov ↗
I got laid off.✦
DI can still pay if you were working or looking for work when your disability began. PFL needs you to be working, job-hunting, or on UI before leave starts. You can't get UI and DI/PFL for the same days. Being fired because you're pregnant is illegal; you have 3 years to file with CRD.

I'm on unemployment and pregnant.✦
Stop certifying for UI when pregnancy keeps you from working, then file for DI.
Source: edd.ca.gov ↗
Thinking about quitting?✦
Quitting usually ends job protection, and UI generally needs "good cause." Talk to Legal Aid at Work first.
Source: legalaidatwork.org ↗
I'm self-employed or a gig worker.✦
You're only covered if you're enrolled in DIEC. To get DIEC benefits, you generally need to have paid contributions for at least 4 months in the 12 months before you apply, and you must be approved before your disability begins. You agree to stay in the program for two complete calendar years. DIEC disability benefits can last up to 39 weeks, and it also includes Paid Family Leave. Confirm your eligibility and dates with EDD. If you think you're misclassified, apply anyway.

I'm a teacher or school employee.✦
Many schools don't pay into SDI. Starting Jan 1, 2027, K-12 public school, charter and county office of education employees get up to 14 weeks of paid pregnancy leave (community colleges pending). Today, educators get differential pay during bonding leave.

I'm a State of California employee.✦
You're covered by SDI or NDI depending on your bargaining unit.

I'm a federal employee.✦
Up to 12 weeks of federal Paid Parental Leave after 12 months of service, with a 12-week work agreement afterward.

I work remotely or live outside California.✦
What matters is a California-based job with CASDI withheld.

My employer has fewer than 5 employees.✦
No PDL/CFRA job protection, but SDI/PFL can still pay you.
Source: calcivilrights.ca.gov ↗
I have complications, or postpartum depression or anxiety.✦
Your provider can certify more recovery time. PDL covers recovery from childbirth, including postpartum depression, up to 4 months total per pregnancy. SDI disability pay can continue as long as your provider certifies you can't work, up to 52 weeks. You're not alone, and asking for help is strong.

I'm pregnant again within a year of my last leave.✦
Since you took leave in the last 12 months, you may have less left this time. PDL is up to 4 months per pregnancy, so it resets with each pregnancy. CFRA bonding is up to 12 weeks in a 12-month period, and PFL pays up to 8 weeks in a 12-month period, so time you already used may count. Also ask HR how they count your 1,250 hours, since time on leave may not count as hours worked. Ask HR and EDD how much you have left.

My baby is in the NICU.✦
CFRA covers caring for a child with a serious health condition, and PFL has a care claim. Ask HR how this fits with your bonding time.

I experienced a pregnancy loss.✦
We're so sorry, mama. California's reproductive loss leave covers miscarriage, stillbirth, failed adoption, failed surrogacy and unsuccessful assisted reproduction, including when it's your partner's loss. It's at least 5 days, at public employers of any size or private employers with 5+ employees, after 30 days on the job. Use it within 3 months, all at once or spread out, and up to 20 days a year for more than one loss. It may be unpaid, but you can use vacation, sick days or PTO. If you need more time to physically or emotionally recover, PDL covers recovery from the loss or end of a pregnancy, and SDI disability pay may apply with your provider's certification. Ask HR and EDD how this applies to you.

Can my partner take leave too?✦
Yes. Both parents can take CFRA bonding leave, even at the same employer, and PFL. Under federal FMLA, married spouses at the same employer share 12 weeks.

Paperwork & proof
How do I know if I pay into SDI?✦
Look for “CASDI” on your paystub; that's your SDI deduction. It's also usually listed in Box 14 of your W-2. You need at least $300 in wages with SDI withheld in your base period (5–18 months before your claim). No CASDI? Ask HR whether your employer uses a Voluntary Plan (you file through your employer) or, for public jobs, whether they're covered by SDI. The surest way to know is to apply, since EDD decides eligibility. Estimate first with EDD's PFL calculator.

How will I know I'm approved, and how much I'll get?✦
EDD mails a Notice of Computation (DE 429D) with your estimated weekly amount (not proof of approval) about 2 weeks after you apply, then an Electronic Benefit Payment Notification (DE 2500E) if you're eligible. Keep both; HR may ask for proof you filed.

What do I need to file my disability (DI) claim?✦
Gather your name, birth date, address, SSN, photo ID plus a second ID document (W-2, utility bill, or birth certificate). Have your employer's name, phone, and mailing address as shown on your W-2 or paystub; your last day of normal work; and any pay you'll still get (sick, PTO, vacation). You also need a provider who saw you in the first 8 days of disability and certifies online or on Part B of the DE 2501.
Source: edd.ca.gov ↗
What do I need for Paid Family Leave (bonding)?✦
Gather the same personal and employer info as for DI. Proof of relationship (birth certificate, hospital birth certificate, Declaration of Paternity CS-909, foster or adoption agreements) is required if you're a new mother without a pregnancy DI claim, a new father/partner, or a foster or adoptive parent. Birth moms moving from DI get the PFL form (DE 2501FP) automatically.

My HR needs a doctor's note for PDL/CFRA. Where do I get it?✦
CRD has free PDL and CFRA certification templates your provider can fill out, with Spanish versions on its family, medical and pregnancy leave page. Your provider doesn't have to disclose your diagnosis without your consent.

My HR sent FMLA forms. What are they?✦
Employers often use Department of Labor forms: WH-381 (eligibility, rights and responsibilities notice), WH-382 (designation notice: whether your leave is approved), and WH-380-E/WH-380-F (health care provider certification).
Source: dol.gov ↗
Where do I find my claim info later?✦
Log into myEDD / SDI Online to file and manage claims. Return continuing-claim forms (DE 2593 / DE 2500A) within 20 days, or benefits stop.

Health, money and return to work
What if I lose my health insurance?✦
Losing job coverage or having a baby opens a 60-day Covered California window. Medi-Cal covers pregnancy up to 213% of the federal poverty level, with 12 months postpartum.

Can I use sick leave for appointments?✦
California paid sick leave is at least 40 hours/5 days a year, usable from day 90.
Source: dir.ca.gov ↗
Will I get pumping breaks?✦
Yes. Every employer must give reasonable break time and a private space.
Source: dir.ca.gov ↗
What does my pumping room need to have?✦
California requires reasonable break time and a private space that isn't a bathroom, near your work area, shielded from view and free from intrusion. It needs a surface, a seat and electricity, plus access to a sink and a refrigerator for milk. Some employers with fewer than 50 employees may qualify for an exemption. Questions: Labor Commissioner, 833-526-4636.

How do I plan my return with my manager?✦
Before leave, make a simple coverage plan: your key work, who covers it, where files live and who decides. Agree how you'd like to keep in touch. You can ask to discuss a gradual return, such as 3 days the first week and 4 the second; it's a request, not a right. A check-in 2–4 weeks after you return helps you both see how it's going.
Source: calcivilrights.ca.gov ↗
Will I get my same job back?✦
If PDL or CFRA applies, your employer must give you back the same or a comparable job, and you can ask for that guarantee in writing. It's illegal for your employer to retaliate against you for taking this leave.
